E-commerce has become increasingly regulated in recent years. Both the practice of selling goods and services through Web Sites to customers (business to consumer or B2C) and the practice of carrying out transactions between businesses online (business to business or B2B) have increased considerably over the last ten years.
We provide advice and guidance to clients on the regulatory requirements which they must meet relating to the kind of e-commerce in which they are engaging. We also have experience in advising on drafting related commercial agreements such as Hosting Agreements and Online Supply Agreements.
Online services are increasingly becoming available and provided entirely online (information society services). For example, an online stock brokering service provides clients with access to stock purchasing systems entirely online and payments are taken from clients entirely online. There are additional requirements in this type of e-commerce under the E-Commerce (EC Directive) Regulations 2002, and we also advise clients of their obligations under these regulations.
