Marlene is an Associate in the company and commercial team, specialising in intellectual property and information technology law. Her experience includes providing branding strategy advice and registering trade marks for her clients, advising on copyright and design right issues. She also advises in relation to intellectual property infringement matters and domain name disputes. Other work includes drafting commercial agreements, including trade mark assignments and licences, franchising agreements, distribution agreements and publication agreements.
She also regularly advises on various types of IT contracts, including Hardware and Software Supply agreements, Support and Mainteance Agreement, Software Licences, Website Terms and Conditions, Terms and Conditions of Sale required for E-commerce websites, and Privacy Policies. She also advises on setting up websites and the various compliance issues that need to be borne in mind when setting up a website and preparing the relevant legal terms and conditions.
Her experience also includes advice on more general commercial contractual matters, including the purchase of services and new products (e.g. a new training package, purchasing support and maintenance services); advising on and drafting terms and conditions relating to the provision of services provided by a county council to members of the public; negotiating and drafting Collaboration Agreements, Partnership Agreements and Information Sharing Protocols; advising on Freedom of Information and Data Protection issues .
Marlene trained in London with Bird & Bird and then moved to Squire Sanders & Dempsey, before joining Foot Anstey in 2002, (made Associate in 2005). She is also a qualified German Rechtsanwaeltin (June 1999).
Marlene was seconded to Cornwall County Council’s Corporate/Commercial Legal Team for 6 months from September 2003 to March 2004.
She is bilingual in both German and English.
