Case Study 1 - Clinical Negligence

A mother contacted us, having been advised that her child (12 months of age) had cerebral palsy.  No explanation had been offered as to why the child had this condition.  We obtained the medical records and sought an opinion from an obstetrician.  The advice received indicated that the mother had been examined a week prior to giving birth when it was noted that her birth canal was colonised by bacteria.  This was clearly recorded in the mother’s notes and the delivery could have been safely carried out if antibiotics had been given to the mother during labour.   This did not happen and directly led to the child’s brain damage.  When pointed out to the Trust, liability was swiftly admitted, thereby paving the way for a settlement in excess of £2m.
