Case Study 1 - Wills
Luke dies without a Will (ie. intestate). He was living with his partner Lucy at his death. They were not registered civil partners but had lived together for 15 years. They had one son, Tom who is aged 13. Luke’s parents, Tessa and Frank both died before him. He is survived by one sister, Miranda, who is 40.
Luke’s whole estate will pass to Tom, provided Tom attains the age of 18 or marries earlier.
If Tom dies before reaching the age of 18 and remains unmarried, then Luke’s whole estate will pass to Miranda.
