Breach of Anti Social Behaviour Orders (Youth Court) – Section 49 CYPA 1933

This 16 year old boy has had a long history of offending.  He was the first boy to have an anti social behaviour order imposed on him in December 1999 when he was 14 and up to March 2002 had 96 convictions for offences including robbery, car theft, driving offences, carrying offensive weapons, violent behaviour, possession of cannabis.  He has been referred to as a one boy crime wave.

The Nottingham Evening Post succeeded in lifting the Section 49 Order automatically imposed when Madigan appeared before the Youth Court for breaching his ASBO.

District Judge Harris said: “Good people must be aware an ASBO is in existence in relation to this defendant.  Society should know when an ASBO is being made and when it is being breached."

District Judge Harris said:

“The public has a legitimate interest in knowing the defendant is the subject of such an order [ASBO] they have a right to know when an order is being breached so they prevent themselves from being victims.  They can only do that if he has been identified.  Decland put the public in great danger and for that reason I am lifting the restrictions.”
