Care of the Elderly and Long Term Care

Demographics dictate that we have an aging population as a nation, an issue with a particular significance in the south west where we have a higher proportion of retired residents than elsewhere in the country.

New legal issues arise in relation to those members of the community who are no longer able to adequately care for themselves. At Foot Anstey we have a team of lawyers who have backgrounds ranging from advising the elderly on financial and inheritance issues through to medical law experts, whose combined talents are particularly well equipped to deal with such challenging new areas of law.

Whether it be assisting individuals, attorneys, deputys or executors who have responsibility for the affairs of the long term sick, we can provide a service appropriate to the client’s level of need.

Disputes relating to responsibility for payment of long term care fees are currently an area of significant concern. In those cases Foot Anstey has experience in advising and assisting clients, ranging from assessing an individual’s entitlement to care, submitting an initial challenge to a Primary Care Trust’s refusal to fund care for a patient, through to Judicial Review proceedings in court where appropriate.

Cases undertaken to date have resulted in the recovery of care home charges, refundable to the patient by the Primary Care Trust. The figures involved vary from case to case but in one instance the Primary Care Trust were obliged to refund a sum in excess of £100,000.
